NR-12 in Brazil — what manufacturers, importers and users must know
NR-12 (Norma Regulamentadora 12) covers machinery and equipment safety. It applies to manufacturers, importers and users of any machine in Brazilian territory. Compliance requires a documented Preliminary Risk Assessment (APR), physical guarding installations, interlocked safety devices, two-hand controls on relevant machines, and detailed technical documentation.

Frequently asked questions about NR-12 compliance
What is NR-12 and when is compliance mandatory? +
NR-12 (Norma Regulamentadora 12) establishes minimum safety requirements for the design, installation, operation and maintenance of machinery and equipment. Compliance is mandatory for all companies operating machinery in Brazil, regardless of size. Machines acquired after 2012 must already leave the factory in compliance. Earlier equipment must be brought into compliance according to a schedule defined by the employer.
What is a Preliminary Risk Assessment (APR) under NR-12? +
A Preliminary Risk Assessment (APR) is the technical process of identifying hazards and estimating and evaluating the risks associated with each machine or piece of equipment. It is the starting point of the NR-12 compliance project: without a documented APR, the company cannot issue a conformity report. The process follows ABNT NBR ISO 12100 and results in a technical report with ART.
What is the difference between hazard identification and risk assessment? +
Hazard identification detects and estimates the risks present in a machine. Risk assessment goes further: it evaluates each identified risk to decide whether it is acceptable or requires a risk reduction measure. NR-12 requires a full risk appraisal (apreciação de risco), which encompasses both analysis and evaluation per ABNT NBR ISO 12100.
Who can sign an NR-12 compliance report? +
The NR-12 technical conformity report must be signed by a legally qualified professional: a mechanical, electrical or safety engineer with an active registration at CREA and a registered ART (Technical Responsibility Annotation). For complex machines, the professional should hold specific qualification in machinery safety — preferably CMSE (Certified Machinery Safety Expert) certification.

Can a company be fined without an NR-12 compliance report? +
Yes. The Ministry of Labour's inspection body (MTE) can fine companies with machines not compliant with NR-12, applying penalties based on NR-28. In addition to administrative fines, in the event of an accident with a non-compliant machine, the company faces civil and criminal liability. There is no single legal deadline for compliance — the employer must establish a schedule and fulfil it.
Which machines are covered by NR-12? +
NR-12 applies to virtually all machinery used in Brazilian workplaces: hydraulic and mechanical presses, guillotines, bending machines (dobradeiras), lathes, milling machines, injection moulding machines, calenders, saws, conveyors, elevators and custom production lines. Each machine type has specific requirements for guarding type, safety distance (ABNT NBR ISO 13857) and performance level (PLr, ISO 13849).
